dc.description.abstractEste trabalho tem como tema central o estudo do incidente de desconsideração da personalidade jurídica, previsto no Código de Processo Civil (CPC) de 2015 e inserido na Consolidação das Leis do Trabalho (CLT) após a Reforma Trabalhista de 2017, no âmbito da Justiça do Trabalho da 7ª Região/CE. Inicialmente será abordada a parte teórica com estudo da construção desse instituto de intervenção de terceiros e que irá fornecer subsídios para uma posterior análise prática das decisões judiciais, permitindo diferenciar os caminhos seguidos nas variadas decisões judiciais a serem analisadas. A Reforma Trabalhista trazida pela Lei nº 13.467/2017, alterou a Consolidação das Leis do Trabalho, incluindo artigo que trata especificamente do assunto, com expressa referência ao regramento da matéria contido no Código de Processo Civil. Neste sentido, face a alteração legislativa que trouxe embasamento legal para o processo do trabalho, mas sem esquecer os princípios que o caracterizam, como o da primazia do credor trabalhista, redução do contraditório e efetividade, o trabalho buscará compreender se o incidente é de fato instaurado nos processos trabalhistas, quais teorias da desconsideração embasam sua adoção nesta específica seara do Direito e quais seus efeitos práticos na resolução das demandas. Serão analisadas decisões proferidas pelo Tribunal Regional do Trabalho da 7ª Região. A metodologia adotada no trabalho será o método indutivo com a pesquisa qualitativa bibliográfica e documental, por meio de análise de conteúdo. Da análise realizada conclui-se que o incidente de desconsideração da personalidade jurídica vem sendo aplicado na Justiça do Trabalho da 7ª Região, após a edição da Lei n. 13.467/2017, sob pena de nulidade processual.
dc.description.abstract2The central theme of the work is the study of the incident of disregard for legal personality, provided for in the 2015 Code of Civil Procedure (CPC) and inserted in the Consolidation of Labour Laws (CLT) after the 2017 Labour Reform, within the scope of the Labour Justice of the 7th Region/CE. Initially, the theoretical part will be addressed with a study of the construction of this third party intervention institute, which will provide subsidies for a later practical analysis of the judicial decisions, allowing the differentiation of the paths followed in the various judicial decisions to be analyzed. The Labour Reform brought by Law no. 13.467/2017, amended the Consolidation of Labour Laws, including an article dealing specifically with the matter, with express reference to the regulation of the matter contained in the Code of Civil Procedure. In this sense, in view of the legislative alteration that brought legal basis to the labour process, but without forgetting the principles that characterize it, such as the primacy of the labour creditor, reduction of the contradictory and effectiveness, the work will seek to understand if the incident is in fact filed in the labour suits, which are the theories of disregard based on its adoption in this specific area of Law and which are its practical effects in the resolution of the demands. Decisions rendered by the Regional Labour Court of the 7th Region will be analyzed. The methodology adopted in the work will be the inductive method with qualitative bibliographic and documental research, by means of content analysis. From the analysis carried out, it is concluded that the incident of disregard for legal personality has been applied in the Labour Court of the 7th Region, after the edition of Law no. 13.467/2017, under penalty of procedural nullity.
